I. Acknowledgment of Risks

I, the undersigned Legal Guardian, acknowledge that participation by my child(ren), whose names are listed at the end of this form, and the attending Caregiver (who may be myself or a designated adult) in the "Mims Magical Toddler Yoga" classes, provided by Mims Magic, a BriViv LLC company, involves inherent risks, including but not limited to, muscle strains, pulls, fractures, falls, slips, and contact with other participants or objects. I understand that the activities may include movement, stretching, balancing, light physical contact, and play that could lead to injury.

I understand that Mims Magical Toddler Yoga classes are not a substitute for medical or psychological diagnosis, treatment, or care. I affirm that my child(ren) and the attending Caregiver are in good physical condition and do not suffer from any known disability or condition which would prevent or limit participation in a children's yoga class.

II. Supervision and Caregiver Certification

I certify that the child(ren) participating are under my direct legal guardianship and that any attending Caregiver is authorized by me to bring and supervise the child(ren). I further certify that the attending Caregiver is 18 years of age or older and understands that they are required to actively supervise the child(ren) at all times during the 30-minute yoga class and the 15-minute social period. I understand that Mims Magic instructors are present only to guide the class and do not assume responsibility for individual child supervision.

III. Health and Safety Certification (Illness Policy)

I affirm that neither I, the attending Caregiver, nor my participating child(ren) will attend class if exhibiting any signs of contagious illness, including but not limited to: fever, cough, runny nose, or flu-like symptoms.

I agree that I will not bring my child(ren) or the attending Caregiver will not attend class until fully symptom-free for at least 24 hours without the aid of fever-reducing or symptom-masking medication. I further agree to inform Mims Magic immediately if I, the attending Caregiver, or my child(ren) experience symptoms of any communicable or contagious illness after attending a class. I recognize the risk of exposure to contagious illness exists and agree to assume that risk.

IV. Assumption of Risk

I voluntarily elect to permit my child(ren) to participate in Mims Magical Toddler Yoga and assume all risks and responsibility for any injury, loss, or damage that may result from our participation. I understand that Mims Magic is not responsible for any personal items lost, stolen, or damaged during class time, including during the social period.

V. Waiver and Release of Liability

In consideration of being permitted to participate in the classes, I hereby agree to waive, release, and discharge Mims Magic, its owner(s), employees, instructors, and agents from any and all claims, demands, losses, or liabilities (including personal injury, property damage, and wrongful death) that I, my child(ren), or any person claiming through us may have against them arising out of or related to my or my child(ren)’s participation in Mims Magical Toddler Yoga.

VI. Indemnification and Hold Harmless

I further agree to indemnify and hold harmless Mims Magic, its owner(s), employees, instructors, and agents from any and all losses, costs, claims, causes of action, damages, and expenses (including reasonable attorney's fees) arising from any and all claims, including third-party claims, brought by me, my child(ren), or any person claiming through us, arising out of or related to my or my child(ren)’s participation in the classes.

VII. Emergency Authorization

I hereby authorize Mims Magic and its instructors to obtain emergency medical care for my child(ren) should they be injured or deemed by the instructor to be in need of medical attention. I assume responsibility for any and all costs associated with such emergency care and transport.
